Thanks for using our products and services (“Services”). The Services are provided by Immense Inc., located in Scarborough, Ontario. Canada. By using our Services, you are agreeing to these terms. Please read them carefully.

Our Services are modular and diverse, so sometimes additional terms or product requirements (including age requirements) may apply.

Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

Using our Services

You must follow any policies made available to you within the Services.

Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
Our Services display some content that is not Ad-Din’s. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please don’t assume that we do.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Ad-din Portal Site and Mobile App is a utility and information web application related to the religion of Islam. Ad-Din and Immense Inc are not affiliated with and do not support any particular political organisation, sect, ideology or denomination.
Ad-Din and Immense Inc cannot be held responsible for the accuracy of the content and information provided on this application as we provide the shell and Software as service and expect organizational staff be diligent in ensuring the accuracy of their content. Whilst every effort is taken to ensure high standards and quality for the content and information provided within this application, Ad-Din and Immense Inc., cannot be held responsible for any personal loss, damage or crisis sustained as a result of using this application. The information provided in this application is not intended to replace any official information provided by your local mosque or any other religious authority unless they decides to announce so.

Your Ad-Din Account

You may need an Ad-Din Account in order to use some of our Services. You may create your own Ad-Din Account, or your Ad-Din Account may be assigned to you by an administrator, such as your employer or educational institution. If you are using an Ad-Din Account assigned to you by an administrator, different or additional terms may apply and your administrator may be able to access or disable your account.

To protect your Ad-Din Account, keep your password confidential. You are responsible for the activity that happens on or through your Ad-Din Account. Try not to reuse your Ad-Din Account password on third-party applications. If you learn of any unauthorized use of your password or Ad-Din Account, Contact Ad-Din support or reset the password as soon as possible.

Privacy and Copyright Protection

Ad-Din’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Ad-Din can use such data in accordance with our privacy policies.

We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the Canada and US. 

Your Content in our Services

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload, submit, store, send or receive content to or through our Services, you give Ad-Din (and those we work with) a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services (for example, for a business listing you have added to Ad-Din Classifieds). Some Services may offer you ways to access and remove content that has been provided to that Service. Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure you have the necessary rights to grant us this license for any content that you submit to our Services.

Our automated systems analyze your content to provide you personally relevant product features, such as customized search results, tailored advertising. This analysis may occur as the content is sent, received, and when it is stored.

If you have an Ad-Din Account, we may display your Profile name and username and actions you take on Ad-Din or on third-party applications connected to your Ad-Din Account (such as Facebook, twitter integration for OAUTH functionality) in/from our Services.

You can find more information about how Ad-Din uses and stores content in the privacy policy or additional terms for particular Services. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you.

About Software in our Services

When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.

Ad-Din gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Ad-Din as part of the Services whether you are on a free of paid version. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Ad-Din, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Open source software is important to us. Some software used in our Services may be offered under an open source license that we will make available to you. There may be provisions in the open source license that expressly override some of these terms.

Modifying and Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

You can stop using our Services at any time, although we’ll be sorry to see you go. Ad-Din may also stop providing Services to you, or add or create new limits to our Services at any time.

We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.

Our Warranties and Disclaimers

We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services.

Other than as expressly set out in these terms or additional terms, neither Ad-Din nor its suppliers or distributors make any specific promises about the Services. For example, we don’t make any commitments about the content within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. We provide the Services “as is”.

Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.

Liability for our Services

When permitted by law, Ad-Din, and Ad-Din’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.

To the extent permitted by law, the total liability of Ad-Din, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).

In all cases, Ad-Din, and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.

We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumer legal rights which may not be waived by contract.

Age Restrictions

Children and Minors
Children under the age of 5 are not eligible to use any of our service. Children between 5-18 can have account in our system supervised by Administrator of an Organization and Parents.

Adults
Adults are allowed to utilize the Ad-Din and its services.

Carpool (Deprecated)

If you are utilizing the Carpool Service, you confirm that you have the minimum age of sixteen (18) years old. You also understand that some drivers may require that the passenger registered to the Service and booking a seat (or seats) aboard their vehicle must be at least eighteen (18) years or, in some case, at least twenty-one (21) years old. The driver has the right to refuse the boarding to a passenger who did a false declaration when booking a seat. Immense Inc., and its affiliates are not responsible in any ways for managing the charges born by the arrangements made by rideshare. Ad-Din only provides the shell to make this arrangement possible between the third-party and not responsible for any arrangements made outside of allowing users to get connected. 

As a passenger registered to our service, you will be authorized to book a seat for yourself and for Guest passenger(s) who will travel with you, with the same driver and aboard the same vehicle. As a passenger registered to the Service doing this type of booking, you will be identified as the Group leader passenger. When booking as the Group leader passenger, you will have to pay the carpool fees and the amount of money asked by the driver for each seats booked for the ride. As a Group leader passenger, you can be accompanied by a Guest passenger that is under sixteen years old only if you are his parent or his legal tutor.

As a registered driver that may provide transportation to other passengers, you certify that your vehicle is insured and that your Insurance policy includes a liability clause, which covers passengers in the event of an accident. It is in your exclusive responsibility to notify your insurance company that you might use your vehicle to carpool with passengers which may contribute financially to help you reimburse the expenses of operating your vehicle for the ride as a non-profit basis.

In order to carpool to cross the border, Ad-Din requires all passengers to meet the documents required to cross the border & free of any criminal record.

By posting a carpool offer as a driver registered to the Service, you agree that Ad-Din act as an agent to achieve the following: (a) find a passenger wishing to book a seat in your vehicle for the ride; (b) provide contact information and all required information to the passenger so that he can complete the ride with you in the vehicle

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. Both parties will hold each other harmless and indemnify the Company and its affiliates, officers, agents, and employees. Indemnification includes any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.  

About these Terms

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective soon they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

These terms control the relationship between Ad-Din and you. They do not create any third party beneficiary rights.

If you do not comply with these terms, and we don’t take action right away, this doesn't mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

The courts in some countries will not apply Ontario, Canada law to some types of disputes. If you reside in one of those countries, then where Ontario law is excluded from applying, Ontario, Canada’s laws will apply to such disputes related to these terms. All claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of Ontario, Canada, and you and Ad-Din consent to personal jurisdiction in those courts.

Code of Conduct

By agreeing to these Terms, you’re agreeing that, when using the Services, you will follow these rules:
i. Don’t do anything illegal, or try to generate or share content that is illegal.
ii. Don’t engage in any activity that exploits, harms, or threatens to harm children.
iii. Don’t send spam or engage in phishing, or try to generate or distribute malware. Spam is unwanted or unsolicited bulk email, postings, contact requests, SMS (text messages), instant messages, or similar electronic communications. Phishing is sending emails or other electronic communications to fraudulently or unlawfully induce recipients to reveal personal or sensitive information, such as passwords, dates of birth, Social Security numbers, passport numbers, credit card information, financial information, or other sensitive information, or to gain access to accounts or records, exfiltration of documents or other sensitive information, payment and/or financial benefit. Malware includes any activity designed to cause technical harm, such as delivering malicious executables, organizing denial of service attacks or managing command and control servers.
iv. Don’t publicly display or use the Services to generate or share inappropriate content or material (involving, for example, nudity, bestiality, pornography, offensive language, graphic violence, self-harm, or criminal activity) or Your Content or material that does not comply with local laws or regulations.
v. Don’t engage in activity that is fraudulent, false or misleading (e.g., asking for money under false pretenses, impersonating someone else, creating fake accounts, automating inauthentic activity, generating or sharing content that is intentionally deceptive, manipulating the Services to increase play count, or affect rankings, ratings, or comments) or libelous or defamatory.
vi. Don’t circumvent any restrictions on access to, usage, or availability of the Services (e.g., attempting to “jailbreak” an AI system or impermissible scraping).
vii. Don’t engage in activity that is harmful to you, the Services, or others (e.g., transmitting viruses, stalking, trying to generate or sharing content that harasses, bullies or threatens others, posting terrorist or violent extremist content, communicating hate speech, or advocating violence against others).
viii. Don’t violate or infringe upon the rights of others (e.g., unauthorized sharing of copyrighted music or other copyrighted material, resale or other distribution of Bing maps, or taking photographs or video/audio recordings of others without their consent for processing of an individual’s biometric identifiers/information or any other purpose using any of the Services).
ix. Don’t engage in activity that violates the privacy or data protection rights of others.
x. Don’t help others break these rules.

Software as a Service (SaaS) allows users to connect to and use cloud-based applications over the Internet. Ad-Din is a SaaS solution designed to help Masjids, Madrasahs, and Islamic Schools manage their operations efficiently with minimal upfront costs.

With Ad-Din, you rent the use of a secure, cloud-hosted application for your organization, accessible via web browsers and mobile apps. All backend infrastructure, middleware, and app data are hosted in Microsoft Canada’s data centers, ensuring high availability, security, and compliance. Ad-Din, in partnership with Microsoft, takes full responsibility for managing the software, security, and system reliability.

Service Level Agreement

Ad-Din Solutions Service Availability SLAs are outlined in this section.

The hosting architecture has been designed to achieve the following Availability SLA: The Availability SLA for Cloud Compute Production Environment (known as Platinum) is 99% uptime translated as follows, cumulative total will be considered. 
• Daily: 14m 24.0s
• Weekly: 1h 40m 48.0s
• Monthly: 7h 18m 17.5s
• Yearly: 3d 15h 39m 29.5s

Excused Downtime From SLA Calculations:

• Any cause outside of the Vendor’s control.
• Intentional shutdowns due to emergency interventions and/or responses to security incidents;
• Problems with third-party components for which the vendor has not provided fixes;

The Customer’s Site shall be considered available to the extent any downtime is due to:

• Regularly scheduled maintenance or service upgrades;
• Content residing on the Customer’s hosting environment;
• Configuration changes initiated by the Customer;
